As part of the Withdrawal Agreement, EEA nationals who were exercising Treaty rights in the UK before 31 December 2020 and had been granted pre- or settled status by the Home Office, shall continue to benefit from the old EHIC regime for free medical care in all EEA states from 1 January 2021 onwards.
This includes ‘McCarthy’ persons who hold dual British and EEA citizenship, as well as certain ‘Chen’ and ‘Ibrahim/Teixeira’ third country nationals. Persons who are British nationals only, unless residing in the EEA and have their healthcare funded by the UK before 31 December 2020, are excluded from the scheme.
Online applications for the new ‘CRA EHIC’ have now opened and this will be formally announced shortly by the Department of Health.
To apply online visit www.services.nhsbsa.nhs.uk/cra/start. Before applying you must first ensure you qualify under one of the multiple categories. To seek legal advice as to whether you or your non-EEA family members qualify, contact clerks@12oldsquare.com.
