The Court of Appeal has handed down judgement in the case of Rahaman & Anor v The Secretary of State for the Home Department [2022] EWCA Civ 310.
Mr Fazli of Counsel (led by Zane Malik QC) appeared before Lady Justice Andrews, Lord Justice Lewis and Lady Justice Thirlwall in this appeal from the Upper Tribunal which concerned, amongst others, the ambit of ”historic and/or historical injustice”, the scope of ”new matter” within the meaning of section 85 of the 2002 Act, the principle of res judicata and the application of the Ladd v Marshall test on the fact of this case.
