Permission granted by the Court of Appeal

The Hon. Lady Justice Nicola Davies has granted permission to appeal against the decision of the High Court to refuse permission to apply for Cart judicial review of the decision of the Upper Tribunal, which had refused the Appellant’s application for permission to appeal against the decision of the First-tier Tribunal, which in turn had dismissed the Appellant’s human rights appeal.

The Appellant was represented by Mr Fazli, who settled the grounds to the High Court and later drafted grounds and Skeleton Argument to the Court of Appeal.

The appeal raises issues of principles, amongst others, as to the proper and holistic assessment of facts and the appropriateness of requiring corroborative expert legal evidence relating to the law of a foreign country.
